Welcome to Danders Photography.
These Terms & Conditions apply to the use of our website and photography services. By booking a photography session, purchasing a product or service, or using our website, you agree to these Terms & Conditions.
Individual photography bookings may also be subject to a separate photography agreement or contract. If a signed photography agreement contains terms that differ from these general Terms & Conditions, the photography agreement will apply to that booking.
1. Photography Services
Danders Photography provides professional photography services, including family, portrait, maternity, couples and other photography sessions.
The exact services, session length, number of photographs, location, pricing and other details will depend on the package or service selected at the time of booking.
2. Booking Your Photography Session
Photography sessions are subject to availability.
Your requested date and time are not guaranteed until your booking has been confirmed by Danders Photography and any required booking retainer or deposit has been received.
Once confirmed, that time is reserved specifically for you.
3. Retainers & Deposits
A booking retainer or deposit may be required to secure your photography session.
Unless otherwise stated in your booking agreement, retainers and deposits are non-refundable because they reserve a specific date and time that may otherwise have been available to another client.
Any remaining balance must be paid according to the payment terms provided with your booking.
4. Cancellations
We understand that circumstances can change.
If you need to cancel your photography session, please contact Danders Photography as soon as possible.
Booking retainers and deposits are generally non-refundable.
Any additional refund eligibility will be determined according to our Refund, Cancellation & Returns Policy, your photography agreement and applicable law.
5. Rescheduling
If you need to reschedule, please provide as much notice as reasonably possible.
Where sufficient notice is provided, we will make reasonable efforts to transfer your booking to another available date.
Repeated rescheduling, last-minute changes or failure to attend a scheduled session may require a new booking and booking retainer.
6. Weather & Outdoor Sessions
Weather is an important consideration for outdoor photography.
Danders Photography may recommend postponing or rescheduling a session because of severe weather, unsafe conditions, poor visibility or other circumstances that could significantly affect safety or the photography experience.
When Danders Photography determines that a session should be rescheduled because of weather, we will work with you to arrange another suitable available date.
7. Late Arrivals
Please arrive at your photography session at the agreed time.
If you arrive late, the session may still need to end at the originally scheduled time because another booking or commitment may follow.
A late arrival does not automatically entitle the client to additional photography time or a refund.
8. Client Cooperation
Great photographs are a collaborative effort.
Clients agree to reasonably cooperate with the photographer during the session and are responsible for the behaviour and supervision of children, family members, guests and pets participating in their session.
Danders Photography cannot guarantee particular photographs when circumstances outside the photographer’s reasonable control prevent those photographs from being created.
9. Children & Minors
A parent, legal guardian or appropriately authorized adult should arrange photography involving children or minors.
Children must remain appropriately supervised throughout the photography session.
The safety and wellbeing of every participant will always take priority over obtaining a particular photograph.
10. Locations & Permissions
Clients are responsible for informing Danders Photography of any restrictions relating to their chosen photography location.
Some parks, venues, businesses or private properties may require photography permits, admission fees or prior authorization.
Unless otherwise agreed in writing, additional location fees, admission charges or permit costs are the client’s responsibility.
11. Artistic Style
Photography is a creative service.
By booking Danders Photography, you acknowledge that you have reviewed our portfolio and are familiar with our general photographic and editing style.
Lighting, weather, location, clothing, surroundings, individual appearance and other circumstances vary between sessions. Therefore, we cannot guarantee that photographs from one session will look identical to photographs from another.
12. Editing & Retouching
Danders Photography selects and edits photographs according to our professional and artistic judgment.
Editing may include adjustments to exposure, colour, contrast, cropping, sharpening and other enhancements appropriate to our photographic style.
Extensive retouching, object removal, body modification, background replacement or other specialized editing may involve an additional fee where requested and available.
13. Image Selection
Not every photograph taken during a session will be delivered.
Danders Photography will select photographs based on technical quality, expression, composition and artistic judgment.
Test images, duplicates, photographs with missed focus, closed eyes, unflattering expressions or other images that do not meet our standards may be removed during the selection process.
14. RAW & Unedited Files
Unless specifically agreed otherwise in writing, RAW files and unedited photographs are not included with photography packages and will not normally be provided to clients.
The finished edited photographs represent the completed work of Danders Photography.
15. Digital Image Delivery
Completed photographs may be delivered through an online gallery, digital download or another delivery method communicated to the client.
Clients should download their photographs promptly and create their own backup copies.
Delivery times may vary depending on the type and size of the photography session, workload and editing requirements.
16. Image Storage & Backup
Danders Photography may retain client photographs for a limited period following delivery.
Our standard image-storage period and any optional extended-storage services will be described in our applicable image-storage policy or photography agreement.
Although we take reasonable precautions when storing client images, permanent archival storage cannot be guaranteed unless specifically agreed as part of a storage service.
Clients are strongly encouraged to maintain multiple personal backup copies of their photographs.
17. Copyright
Unless otherwise agreed in writing, Danders Photography retains copyright in the photographs we create.
Purchasing a photography session or receiving digital photographs does not automatically transfer copyright ownership to the client.
Clients receive permission to use their purchased photographs for personal, non-commercial purposes, including displaying, printing and sharing their photographs with family and friends.
Photographs may not be sold, commercially licensed or substantially altered for commercial purposes without written permission from Danders Photography.
18. Social Media
Clients are welcome to share their photographs on social media for personal use.
Where practical, we appreciate credit to Danders Photography when our photographs are shared publicly.
Clients should avoid applying heavy filters or alterations that substantially change the appearance of professionally edited photographs.
19. Portfolio & Promotional Use
Danders Photography may request permission to feature photographs from sessions in our portfolio, website, blog, social media, advertising or other promotional materials.
Where specific consent or authorization is required, photographs will be used according to the permissions applicable to the session.
Please speak with us if you have privacy concerns regarding the public use of your photographs.
20. Prints & Photography Products
Prints and personalized photography products are produced specifically for each client.
Clients are responsible for reviewing their selections before submitting an order.
If a product arrives damaged, defective or incorrectly produced, please contact Danders Photography promptly so that we can investigate and arrange an appropriate solution where applicable.
21. Digital Products
Because digital photographs and downloadable products cannot physically be returned once delivered or downloaded, they are generally non-refundable after delivery, except where otherwise required by applicable law.
22. Gift Certificates
Gift certificates may be used toward eligible Danders Photography services according to the terms provided with the certificate.
Gift certificates have no cash value and are generally non-refundable except where required by law.
23. Promotions & Special Offers
Promotional codes, discounts and special offers are subject to any conditions stated with the promotion.
Promotional offers cannot normally be combined unless specifically stated otherwise.
Discounts and promotional credits have no cash value.
24. Website Content
Unless otherwise stated, photographs, graphics, text, branding and other original content appearing on the Danders Photography website are owned by or licensed to Danders Photography.
Website content may not be copied, reproduced, sold, republished or commercially used without appropriate permission, except where permitted by law.
25. Website Availability
We make reasonable efforts to maintain our website and online services but cannot guarantee that they will always operate without interruptions, technical problems or errors.
We may modify, update or temporarily suspend portions of the website when necessary.
26. Third-Party Services
Our website and photography services may use third-party providers for functions such as payment processing, online galleries, website hosting, email communications, analytics, image storage or booking services.
Use of third-party services may also be subject to the provider’s own terms and privacy policies.
27. Privacy
Your privacy is important to Danders Photography.
Information collected through our website, bookings and photography services is handled according to our Privacy Policy and applicable privacy requirements.
28. Limitation of Liability
Danders Photography will take reasonable care when providing photography services and handling client photographs.
However, to the extent permitted by applicable law, we cannot be held responsible for circumstances outside our reasonable control, including severe weather, venue restrictions, equipment failure despite reasonable precautions, third-party service interruptions, illness, emergencies or other unforeseen circumstances.
Nothing in these Terms & Conditions excludes or limits rights or remedies that cannot legally be excluded under applicable consumer-protection laws.
29. Force Majeure
Danders Photography will not be considered in breach of these Terms where performance is prevented or significantly delayed by circumstances beyond our reasonable control.
This may include severe weather, natural disasters, emergencies, government restrictions, serious illness, venue closures, power failures or other extraordinary events.
Where possible, we will work with affected clients to find a reasonable solution.
30. Changes to These Terms
Danders Photography may update these Terms & Conditions periodically to reflect changes to our services, business practices or legal requirements.
The latest version will be published on our website with an updated revision date.
Terms applicable to an existing booking may also be governed by the photography agreement in effect when that booking was made.
31. Governing Law
These Terms & Conditions are governed by the applicable laws of Ontario and Canada.
Nothing in these Terms is intended to remove or restrict consumer rights that cannot legally be waived.
